Terms of Use

The platform is operated by AvaEra. AVAERA GLOBAL VENTURES SDN. In these terms “we”, “us” and “the company” mean AvaEra; “you” and “member” mean the holder of a registered account.

AvaEra is a product business. You earn by selling products and by building a team that sells products. Nothing offered here is an investment, a security, a deposit, or a scheme that pays a return on money placed with us.

We make no promise, projection or guarantee of income of any kind. What any member earns depends on what they and their team actually sell, and many members earn nothing. Do not join on the basis of an income figure quoted by anyone, including another member — no such figure is authorised by us.

You must be at least 18 years old and give accurate registration details. One person may hold one account. You are responsible for keeping your password confidential and for everything done through your account.

Accounts are personal and may not be sold, rented or transferred. You may record a beneficiary in your profile; that records who we should contact and whose claim we would expect, and does not by itself transfer the account. Any transfer on death or incapacity is at our discretion and subject to proof we consider satisfactory.

We may suspend or close an account that breaches these terms, that we reasonably believe is being used fraudulently, or where required by law.

All purchases are final. We do not offer refunds, cancellations or cooling-off returns on any order. Commission on an order is recorded when it is paid and released to your upline on a schedule — weekly, monthly or quarterly depending on the bonus. Once released it cannot be recalled from the members who received it.

The only exception is a short window after you order. You, or we, may cancel a paid order only while nothing from it has been redeemed and none of its commission has been released; the Points you paid with then go back to your wallet. After that the order cannot be cancelled.

Separately, a top-up you have not spent may be returned to your own bank account, less a handling charge, only if you have never made a purchase. Once you have bought anything, top-ups cannot be returned.

Please buy the quantity you intend to use or sell. See section 5 for the one circumstance in which goods may be exchanged.

If a product reaches you spoiled, damaged or past its expiry date, we will exchange it one for one for the same product, provided you tell us within 3 days of receiving it.

The 3 days run from the day the goods reach you — for stock you redeem from a holding, that is the day it is delivered or collected, not the day you bought it. Keep the packaging and be ready to show us the problem. This is an exchange, not a refund: no money is returned.

Buying does not automatically ship goods. What you buy is held to your account and you choose when to release it — couriered to the address on your profile, or collected in person at one of our listed collection points. Your remaining balance is shown in your account at all times.

If an item is out of stock when you order, you will be asked to agree to wait before you can buy it. It is reserved for you and is expected to be ready to collect or send within one month.

Keep your delivery address current. We deliver to the address as it stands when you make the redemption request. Delivery is charged at the rate shown when you request it. Delivery timescales are estimates and depend on the courier.

For delivery to Singapore, any import GST charged by Singapore customs is payable by you to the courier on delivery. You are shown an estimate before you confirm.

If you resell our products — including on any e-commerce platform, marketplace or social selling channel — you may not list or sell below our published retail price. Undercutting the retail price damages every other member selling the same product.

We monitor this and enforce it:

• First occasion: a formal warning, and you must correct or remove the listing.
• Second occasion: your account is banned. Any unreleased stock and any unpaid commission may be forfeited.

You must also not present yourself as an employee, agent or official distributor beyond your actual status as a member, use our brands in a way we have not approved, or make any medicinal, therapeutic or curative claim about the products.

Your account holds two balances. Cash is the part of your commission paid as cash; it may be withdrawn to your own bank account or converted into Points. Points come from top-ups you pay for and from the part of your commission paid as Points, and may be used only to buy products from us.

Converting Cash into Points is one way and permanent. Points cannot be turned back into Cash, cannot be withdrawn, and have no cash value, except that an unspent top-up may be returned as described in section 4. Balances cannot be transferred between members.

Withdrawals are subject to any minimum, fee and monthly limit published in your account at the time, and are paid only to a bank account in your own name.

Being active is what lets you earn commission on new sales, including a share of the company pool. Your membership period runs monthly from the date you joined. You remain active by either of the following within a period: buying a product or set yourself, or having anyone in your first two sponsor generations make a purchase. Signing up a new member does not count until they buy.

Doing so keeps you active for the rest of that period and for the whole of the following one. Being inactive does not close your account. You do not earn on new sales while inactive, but you can still shop, redeem stock you already own, and withdraw or convert balances you have already earned.

We may keep a member active until a stated date whatever they buy. If this applies to you, your account shows the date.

Commission is calculated under the compensation plan in force at the time of the sale. We may change the plan, the rates, the ranks and the qualifying conditions, and will publish changes in the platform before they take effect.

Commission is credited on a schedule rather than instantly — sponsor bonuses and your own rebate weekly on Monday, the team bonus monthly on the 1st, and the company pool quarterly — and may be reversed if the underlying order is reversed or found to be fraudulent. We may withhold commission while we investigate a suspected breach of these terms.

Commission is paid to you gross. We do not deduct or withhold tax from it. Commission you earn is your own income, and you are responsible for declaring it to the Inland Revenue Board and paying any tax due.

Where the total we pay you in a calendar year exceeds RM5,000, we will give you a statement of those payments by 31 March of the following year, as required under section 83A of the Income Tax Act 1967.

We cannot give tax advice. If you are unsure how to declare this income, please speak to a qualified tax agent.

Our products are cosmetics. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Results differ from person to person. If you have a skin condition or a known allergy, patch test first and seek medical advice.

Nothing in these terms limits liability that cannot be limited by Malaysian law, including for death or personal injury caused by negligence or for fraud.

Subject to that, we are not liable for indirect or consequential loss, for lost profits, or for income you expected to earn as a member. Our total liability to you in connection with the platform is limited to the amount you paid us in the twelve months before the claim arose.

We may change these terms. Material changes will be notified in the platform, and continuing to use your account after they take effect means you accept them.

These terms are governed by the laws of Malaysia and the courts of Malaysia have exclusive jurisdiction. They are published in English; if we provide a translation and the two disagree, the English version governs.
